Ovitz: Clash Of Disney Titans May Be Delayed

NEW YORK - Doers and doings in business, entertainment and technology:

It's not just current execs that are giving The Walt Disney Co. (nyse: DIS) fits.

Lawyers for shareholders behind the long-running trial over the severance given to ex-President Michael Ovitz are seeking to delay the trial's start to February from mid-October, because of new evidence.

Shareholders filed suit in 1997 over Ovitz's $140 million package, claiming the board was negligent both in hiring and firing Ovitz, and that Chief Executive Michael Eisner allowed the severance as a face-saving measure.

Disney produced several large boxes of documents from Ovitz's files last month and a Delaware judge ruled Sept. 21 that the 3,000-plus pages could not be admitted at trial because the deadline for discovery had long passed.

But lawyers for Ovitz and former board members (and Eisner opponents) Roy E. Disney and Stanley Gold asked for time to show the material to their clients to prepare for the trial.

Ovitz's lawyer said he sees no reason for a delay; Disney declined to comment on the latest maneuvering.
