Shareholders filed suit in 1997 over Ovitz's $140 million package, claiming the board was negligent both in hiring and firing Ovitz, and that Chief Executive Michael Eisner allowed the severance as a face-saving measure. Disney produced several large boxes of documents from Ovitz's files last month and a Delaware judge ruled Sept. 21 that the 3,000-plus pages could not be admitted at trial because the deadline for discovery had long passed. But lawyers for Ovitz and former board members (and Eisner opponents) Roy E. Disney and Stanley Gold asked for time to show the material to their clients to prepare for the trial.
